Identification, Arrest, Assault with a Deadly Weapon

Silver Creek High School
Follow-up by San Jose Police Department (SJPD) and the School Liaison Unit resulted in the identity and arrest of a suspect and others associated with hitting a summer school student on the head with a baseball bat at Silver Creek High School. All parties involved were summer school students. Two more victims were also discovered.

Armed Robbery/Possible Hate Crime

Tully Road at Quimby Road
The victim was walking through the Food Max parking lot when two Asian males attacked him, punching and pushing him to the ground. The suspects made a homosexual slur against the victim and one of the suspects brandished a knife at him. The victim thinks the rainbow tassel that was attached to his backpack might have motivated the attack.

Grand Theft by Deception

Food Max parking lot, Tully Road/Quimby Road
An elderly victim was approached by a man and woman who said they had a winning lottery ticket. The couple told the victim that the ticket was a winner for $15,000 and that they didn’t have legal status in the United States. The couple told the victim that they would sell the lottery ticket for $3,000 in cash. The couple then faked the female having a diabetic seizure, and gave the victim cash to go into the grocery store and buy fruit juice. The couple then fled in a newer van with the victim’s $3,000.

“Code Red” Presentation

SJPD officers gave a “Code Red” presentation to the San Jose/Evergreen Community College District Police. If adopted, Code Red will ensure that any response to a critical incident by the SJPD to Evergreen College or San Jose City College will follow the same procedures that are already in place in San Jose’s K-12 schools.

Assault with a Deadly Weapon, Mutual Combat

3200 block of Flintdale Avenue
Several males were involved in a physical fight during a party at a residence on Flintdale Avenue. Two of the subjects arrived at Regional Medical Center. One subject had a stab wound to the right side of his chest and the other subject had a laceration to the back of the head. A third subject arrived at Valley Medical Center (VMC) with a stab wound to the chest. All injuries were non-life threatening. The fight was mutual combat and sent for District Attorney review.

Taser Deployment, Possession of a Dangerous Weapon (Knife)

3100 block of Capelaw Court and Ruby Lane
Police officers responded to reported weapons brandishing and suicide threats. Upon further investigation, it was determined that the suspect was depressed and possibly under the influence of drugs or alcohol. The suspect fled prior to police arrival armed with a 6- to 8-inch kitchen knife. The suspect returned to the residence, where officers met him at the front door. The suspect resisted officers and refused to cooperate while advancing upon the officers. The taser was deployed and the suspect was taken into custody without further incident. The suspect was transported to Regional Medical Center for medical clearance. No officers were injured.

Auto vs. Pedestrian Collision

2400 block of Elkins Drive
A motorist struck an 8-year-old juvenile while he crossed a residential street, mid-block at Elkins Drive and Pomeroy Drive. The juvenile was transported to Columbia Medical Center via AMR and reported to have sustained minor injuries. The juvenile apparently entered the roadway without first looking.

Vandalism/Possible Hate Crime

1500 block of Flannigan Drive
Unknown suspects smashed an office window to the victim’s business. The victim is a pediatrician, who has practiced in San Jose for 21 years. He has been a target of vandalism in the past, after being identified with a particular religious group.

Possible Arson Attempt

Montgomery Elementary, 2010 Daniel Maloney Dr.
The San Jose Fire Department responded to the school’s main office building to put out a box fire. The damage was limited to a smoke stain on the sidewalk and wall (3 feet by 1 foot). No structural damage occurred. A standalone construction trailer next to Room 11 appeared to have been tampered with.

Shooting into Inhabited Dwelling

3100 block of Centerwood Way,
3200 block of Adamswood Drive,
3600 block of Deedham Avenue
There were three reported drive-by shootings in this district over the weekend. Small caliber shell casings were recovered from the scene. The occupants were not injured. Officers developed information on the suspect and arrested him at his home. Officers recovered a handgun that they believe was used in the shooting.

Use of Force

2100 block of Laddie Court
A 52-year-old male threatened to kill his parents if they forced him to take his medication. He suffers from mental disorders. The subject ran outside and became difficult, hitting cars and running around. The subject initiated a combative approach with officers. The taser was used to subdue him. He was taken to VMC, medically treated and placed on 72-hour hold.

National Night Out

Officers covering the Evergreen area attended National Night Out events on the 2700 block of Othello, the 1800 block of Monrovia, the 2900 block of Bradbury, the 2800 block of Corda, the 3300 block of Montecito, the 2900 block of Vanport and at King and Barberry.

Strong Armed Robbery

North White Road/Quimby Road
Two suspects in a vehicle grabbed the victim’s purse in the parking lot of the above location. The victim did not let go of the purse, and was dragged at least 100 feet before falling down. The victim was transported to San Jose Hospital with non life-threatening injuries. The suspects are outstanding.

Attended Death

3000 glock of Rubion Drive
Officers responded to a call of a dead body at the above location. When they arrived on-scene, they discovered the 91-year-old victim had passed away from natural causes. The victim suffered from stomach cancer and other medical conditions. The attending doctor signed the death certificate.

Assault with a Deadly Weapon

South King Road/Flanigan Drive
The suspect and victim got into a verbal argument over the parking stall in the parking lot of the 7-11 Store. The suspect brandished a knife. The victim grabbed the knife blade and cut himself in the hand. The suspect drove off. Family members transported the victim to the hospital.

Carjacking/False Imprisonment

South King Road/Flanigan Drive
The suspect forced a victim into his own car at the 7-11 parking lot. The suspect told the victim to drive to the area of South White and Wesboro Avenue. After taking the victim’s wallet, the suspect drove off in the victim’s car.

Assault/Resisting Arrest

2600 block of King Road
Officers responded to a disturbance involving a 46-year-old suspect who was reportedly armed with a knife. When officers arrived, the suspect confronted them and would not comply with commands. Officers sprayed the violent suspect with OC spray. The suspect was taken into custody and transported by ambulance to VMC because of breathing difficulties. Officers later booked the suspect for assault, resisting arrest and outstanding warrants.

Sheriff’s Office Request for Assistance

Tully Road/White Road
Police officers responded to a request by the Sheriff’s Office, which had been pursuing a vehicle that crashed between Tully Road and White Road. The suspect driver had fled the scene. A perimeter was set and the suspect was apprehended a short time later. An officer arrested the suspect as he was trying to leave the perimeter. The victim driver in the crash had minor injuries and a traffic unit took the report.

Felony Drunk Driving

Capitol Expressway/Tully Road
The driver of a vehicle collided with a traffic signal. The passenger in the vehicle suffered a broken neck. The driver was booked for felony drunk driving.

Officer Involved Accident

3900 block of Gardie Place
Officers responded to a welfare check. A citizen backed out of his driveway and into a police vehicle. There were no injuries, and the vehicles had only minor damage. The collision is being investigated.

Attended Death

4000 block of Loganberry Drive
The 77-year-old male hospice cancer patient succumbed to his illness. A family member located the victim and called EMS. The Fire Department pronounced the victim dead and the Coroner’s Office provided a release.

Felony Warrant

1700 block of Monrovia Drive
MERGE and VCET officers conducted an operation resulting in an arrest. The suspect had a felony arrest warrant for a murder he committed last year in Sunnyvale. The suspect was located at a residence in San Jose. The suspect refused to surrender for approximately two hours. A sergeant was eventually able to talk the suspect into peacefully exiting his house where he was taken into custody.
